Medical Debt Relief - Unavoidable Unless You Are a Millionaire Today

Why is it important to keep your medical debt under control at all times? This form of debt is something that all of us are susceptible to. Unless you are a millionaire in America today, you will definitely have to plan for the possibility of facing financial problems due to emergency medical expenses. Health care is very expensive and health insurance policies, despite charging a lot of money as a premium, do not offer comprehensive benefit. The end result is that medical debt gets added to the existing credit card debt and other personal unsecured loans that the individual owes.

It is impossible to plan for this form of debt because you never know when it is going to occur. The idea of keeping fifty thousand dollars in a separate bank account for medical emergencies sounds very good. However, how many of us can afford to have such a huge amount lying idle? Further, how many have the discipline to keep it safe despite facing medical emergencies?

As on date, debt is not something that we rely on because we have a choice. We make use of credit cards and personal loans and other unsecured debts because our monthly income is not enough to manage our expenses and to lead a healthy and stable life.

Medical debt settlement involves securing a waiver ranging from forty to sixty percent of the original amount owed. This is a good thing because bulk reduction of debt will help us come to terms with the other problems faster. Further, the service providers are prepared to offer an installment facility for repayment of the balance amount. That is to say, the deal offered is the same as debt settlement with the only difference here that the lender in question is not a financial institution but is a medical institution.

The settlement deal sounds very good. However, you will have to do a lot of research and homework if you want to get the best possible deal. Lenders are never keen on offering generous waivers without being convinced that the borrower deserves the same. The same is the case with financial institutions as well. If you simply walk into the billing department and request a waiver, you will probably get a five percent discount or will be advised to opt for bankruptcy. On the other hand, employ a professional and you will find your chances of securing a high waiver increasing drastically.

Having medical bills unexpectedly come up in your life can be devastating, especially if you were barely making it before. Most people will think that filing for bankruptcy and clearing this debt would be the best choice, while the complete opposite is true. Filing for bankruptcy will destroy your credit for seven or more years and should be avoided at all costs.

After filing for bankruptcy you'll have a very hard time receiving any kind of loan, such as for a home, car, or anything else. You job application may even be denied because of bankruptcy.

The alternative to filing for bankruptcy is to remove the debts yourself. Debt settlement is one option that has worked well for many people. This works the same as credit card debt settlement except it's for your medical bills.

Your debt settlement company of choice will negotiate with the creditors until a mutual agreement is made. Show your hospital that at the current rate you will not be able to pay off the debt and will need to file for bankruptcy unless an agreement is met. Your monthly payments and overall payment will almost always be reduced.

If you decide to negotiate yourself without a company be prepared to back up your preposition with logic, evidence, and be prepared for counter offers. Make it a point that without reduced rates you will be filing for bankruptcy and they won't be receiving anything. It's in their best interest to receive at least 50 or 60% of the debt than none of it.

Keep in mind that it's a negotiation, and both parties must be satisfied with the end result. Be persistent, sometimes hospitals deny the first offer just to weed out customers who aren't persistent. Continue to send offers and counter offers until one is accepted. If an offer is accepted be sure to write the entire agreement down and have it signed. Never make oral agreements without documenting it.

Bankruptcy Vs Medical Debt Settlement - Do Not Rely on Experts Alone - Use Your Common Sense As Well

There are many persons who feel that medical debt settlement is not a smart move. They point out the fundamental difference between medical debt and credit card debt. They indicate that the former is the result of a service that you have used and the latter is the result of a loan that you have taken.

The two are completely different as far as purpose and the origin are concerned. However, once you discover the difficulties involved, both loans can be treated as the same.

Do you know that medical bills attract interest in the same way as credit card debts? The penalties and penal interest levied on this debt is also the same as unsecured loans. In fact, if you do not repay medical bills on time, both these debts are unsecured debts only.

Your health care provider does not insist you to hand over any asset or property as security, right? In this situation, it is but obvious that there are many similarities between medical debt and credit card debt.

Now, when debt settlement will work for credit card debts, why can it not work for medical bills? The question is whether the lender will be prepared to waive 50% to 70% of the amount owed. Well, even credit card issuers are never keen or enthusiastic about settling the debt.

However, when they are clearly told that the consequences of non settlement shall be bankruptcy, you will find that they quickly become prepared to overcome the problem by offering a waiver. The same is the case with medical debts as well. If you demand it as a matter of right, you will be refused settlement.

On the other hand, if you go in for the option of bankruptcy, medical lenders stand to lose a lot and they will definitely be eager to help you out with a settlement as long as it helps in recovery of debt. Nobody likes to lose money and medical service providers are no exception to this rule.

If you still do not feel that settlement will work for hospital bills, just employ the service of professional debt company. You can easily find the right company online. As long as you choose the right method and the select the honest company, you can stay cool and composed as you will get a waiver irrespective of whether the loan under consideration is credit card or medical debt.

Medical Bankruptcy - Using Credit Card to Pay Medical Bills is a Bad Move - Use Settlement Instead

In 1981, 8% of all individuals who filed for bankruptcy did so because they were facing the problem of medical debt. On the other hand, this figure has risen to more than 50% today. This is a drastic increase and clearly indicates the correlation between medical debt and bankruptcy. It is surprising that people are not prepared for the same.

People check out debt relief options when they apply for a credit card. They think of debt consolidation, settlement, interest holiday, postdated checks and other such solutions. When people plan for medical debts, they focus on the individual undergoing the treatment and do not even bother to think about the payment. They feel that the health insurance policy will be enough to take care of all medical payments well.

Well, 75% of all those who opt for bankruptcy because of medical reasons do so despite having health insurance. This means that the cost of healthcare is so high that mere insurance is not enough to overcome the problem. In any case, there are certain aspects and facets that insurance does not cover. Postoperative care and nursing is one such example.

So, what should one do? One cannot avoid falling ill. One should learn about medical debt settlement. One should find out how the concept works. One should make use of the World Wide Web to find out whether it is a legal option or whether it is a scam. Filing for bankruptcy, although it sounds attractive, is the worst option around.

In any case, you cannot declare bankruptcy for a specified period of time once you have opted for it once. This means that you cannot use bankruptcy to escape medical debt again and again. On the other hand, debt settlement is a much better option.

By employing a professional to intercede on your behalf, you will bring down your debt by more than half. The lenders, in this case the medical service providers, are agreeable to such a deal because the only other alternative is bankruptcy. It is an epoch event in your financial life. It is disastrous deal for the service provider as well. With nobody gaining from the deal, it is surprising how bankruptcy is even suggested as solution for medical debt.

If you play your cards right, you can overcome all your medical loan problems and you can bring your financial life back on track even as your family members recuperates from the treatment.

Do your Medical Homework

One of the many steps in attaining a cheaper medical bill is to perform a bit of research. You have to do some medical homework by intentionally knowing the medical processes that you must undertake and its equivalent costs. You can attempt by calling hospitals and asking for the rate of each procedure that you are about to undertake, better yet you can also ask if there is an alternative procedure which is much cheaper. The objective here is to obtain as much data as you can in relation to the costs of the procedure and maybe a substitute operation or procedure. In doing so, you just might be able to find the perfect institution that offers the exact same procedure at the most economical rate. Plus, you can also put to good use this knowhow when you start to negotiate on your medical bill, which will be talked about in greater detail below.

Bargain for a Cheaper Bill with Your Healthcare Provider

You can talk about different payment possibilities with your doctor. Speaking with each of them and bargaining their professional charges down could lower your bill. Moreover, you can also speak with the staff of the billing department because they are likely to have the power to lessen the cost of your medical bill. In addition, once you are acquainted with the prices for the procedure, you will have better influence in bargaining.

Cash Payment

If you offer the doctor or the hospital a prompt cash payment, ask for a reduction. Doctors and hospitals alike are more than eager to receive ready money for payment with discounts. The healthcare provider is able to pass on to you these medical bill savings since you are assisting them decrease client invoices forwarded to collection agencies and driving down the time and cost of medical billing for them.

Take Advantage of Medical Procedures during its 'Off-Peak' Period

There are some medical operations that have peak and off-peak periods, just like in travelling. So, if you are preparing to get a medical operation such as plastic surgery, then avail of it during the off-peak time, especially after the summer so that you can have an 'off-season' deal.

Paying Off Your Medical Bill Debt, The Easy Way

We all know how bad it will be for our financial standing if our credit score is ugly. Therefore, if you have incurred a medical bill debt in the past, you must pay it off properly or else the next time you apply for a loan, you'll have a hard time getting approval...that is, if you still get approved.
On the same breath, we also know how bad a time it will be for you to have someone dear to you admitted in the hospital and you're already buried in debt due to the medical bills piling up. That is why, in this article, we will show you how to get ready for such hard times. Here are a few time-tested tips:
The first thing that you need to straighten up is your attitude towards your medical bill debt. The moment that you get your medical bill statement, you know that you must pay it off as soon as possible. Think like this: you are about to save a life. Be very motivated to find easy, fast and legal ways to pay it off. Keep this motivation strong and make it reflect in the way that you handle money. If you are admittedly having a hard time catching up, cut back, save every cent you find and most of all, keep your eyes open for many earning opportunities.
Next, round up all the assets you have starting with cash. If you have savings (good for you!), add that amount up to your cash-on-hand. That's the total cash that you have. See how that would fare against the medical bills. If it's not enough, you can pick between loaning or pawning, which one you'd want to come first. Here, you'd need to round up all the other assets aside from cash, to turn them into cash.
If you pawn off, you can get the money fast. Less hassle-that's the ultimate advantage. If you opt to loan, however, you might have to sign more papers and the approval may take a few days. Many medical loans have lower interests than pawnshops, and if you have a car or real estate property as collateral, then you don't have to turn the actual item in, you only need to give a certificate of ownership. Whichever option sounds good for you, go for it. You may also try to loan from your friends or relatives without having to turn in a collateral, or have other gadgets or jewelry serve as such. Really, it depends on how much you need and how much time you actually have.
Pay off your medical bills as soon as you have the money. It doesn't matter if you just scored a small fraction of the bills at the beginning. The most important thing is that your debt is moving. And it's shrinking. Interest can be really suffocating and you wouldn't want that extra baggage.
Lastly, always have back-up plans. What if you end up taking a payless leave from work? (By then, your regular income won't come anymore.)What if you don't have anything else to pawn off or give as collateral? What if the bills suddenly balloon because there's a new complication discovered? Don't leave yourself empty handed and try your very best to not be ashamed to ask for help. Hospitals can be forgiving about your medical bill debt but the other institutions might not be.

What To Do When A Lawsuit Is Filed Against You Over Unpaid Medical Bills

When you get medical bills and leave them unpaid, you begin to get past due notices on the unpaid medical bills. If you continue to ignore the medical bills, the next step is collection notices. The health care system is known to take advantages of the state laws and use all necessary to collect their money. At this point if you continue to ignore the debt they can take legal action against you, which could include wage garnishment, liens judgments. If you receive legal notices, you should contact an immediately. If determined none of these are applicable in helping you, the health care industry can sell your unpaid medical bills to collection agencies that will hound you daily, through all communication methods possible for what seems like forever.
Do not sweep the unpaid medical bills under your rug, and hope they disappear; especially if the wheels of the legal system have already began to turn. When you receive a summon, for example, you are duty bound to answer if you don't want your troubles to mount. Understandably, families who receive the summon over unpaid medical bills think it's the end of the world for them, but it's nothing more than a document that tells you that you where to be, when to be there, and for what reason.
A lawyer will be able to help you with this but basically, you just have to agree or disagree with all the accusations leveled against you. You can also do this on your own, simply by answering questions to the allegations. There are some instances where you can send your reply via mail or hand it to the court personally on or before the due date.
However, when you are already dealing with the court, it's always advisable to seek legal assistance to make sure nothing is lost in the translation. Remember there are many options available to help you get relief from your unpaid medical bills and to avoid legal issues.

Today, Filing Bankruptcy Might Be A Great Investment

Spending money to file for bankruptcy almost sounds counterproductive, but it could be the best investment your family ever made. In today's economy, banks are only paying barely 1% for money in one's savings account. The volatility of the stock market makes it a terrible investment for anyone that needs a long-term return. Today, most Americans are buried under a mountain of credit card debt and are continuing on making the minimum payments just to keep those accounts open. Most people think that taking money out of a savings account to pay off credit card debt is off the table even though they are probably paying 26% interest on a credit card and receiving 1% interest on the savings account. Most people understand the whole concept of protecting what assets you have for a rainy day. That's why, if there is no way out of debt, filing bankruptcy should be considered.
Back in 2010, the Wall Street Journal reported that the average American household had approximately $40,000 in personal debt. This is a substantial amount of debt that is next to impossible to pay off considering the interest rates being charged. An easy test for a person to take is to add up all their credit card bills and budget a monthly amount that is affordable to pay on the debt. If the debt cannot be paid off in six years if there are no more charges to the account, a bankruptcy filing should be considered. Filing bankruptcy can be a way to regain control of an individual's life and pocketbook. Doing nothing, might seem tolerable and safe, will keep the individual in bondage to those debts for life. Most people have to weigh the positives against the negatives before deciding to file for bankruptcy. The easiest way to do this is to drop in on a bankruptcy attorney and have them take a look at the individual's financial situation. The other way is to just do some research on the Internet.
If someone is on the fence and having trouble deciding on filing bankruptcy here are a few things that might sway their decision.
  1. Right now is a good time to file for bankruptcy because the economy is down and the value of the individual's property is much lower making it easier for the bankruptcy attorney to protect more property with the bankruptcy exemption laws.
  2. Eliminating the stress is probably the best reason but usually not considered in the beginning. Stopping the creditors from constantly calling and threatening an individual can ruin a person's health and marriage. Protecting one's health should be at the top of the list.
  3. Not filing bankruptcy because you're worried about your credit report is foolish. Usually when a person gets to the place where bankruptcy filing is on the table, the person's debt ratios and late pays have probably already destroyed their FICO score. After the bankruptcy discharge, the individual can quickly start rebuilding their credit putting the bankruptcy far behind in the rearview mirror.
  4. Depending on the age of the individual filing for bankruptcy, a person should not wait until they are ready to retire. Facing bankruptcy head-on will allow the person to recover before retirement.
  5. With the large number of families facing foreclosure, filing bankruptcy will eliminate any liability on a piece of property that the individual might want to surrender back to the creditor. It also can help an individual avoid foreclosure by eliminating all the unsecured debts that in many cases will free up enough money to make the mortgage affordable.
  6. Filing bankruptcy will stop foreclosure. Filing Chapter 7 bankruptcy will stop foreclosure at least temporarily. Depending on the situation, the creditor has the right to file a relief of stay allowing them to restart the foreclosure process. Filing Chapter 13 bankruptcy is a better option when the individual is filing for bankruptcy for the reason of protecting a piece of property. All individual's situations are different and should be discussed with a bankruptcy attorney as the results very.
For those in debt, inaction or pecking away at it slowly will solve the problem. People in this situation should consider discussing the matter with a bankruptcy attorney to see if filing bankruptcy will work for their situation. Many people find out that the facts they thought they knew about bankruptcy are more based on myths than understanding.
The author is a professional that formed FilingBankruptcyNow.Com which provides information for debtors considering filing bankruptcy under Chapter 7 and Chapter 13 bankruptcy and helps individuals stop foreclosure and eliminate their debt by putting them in touch with a local bankruptcy attorney.

Struggling To Pay Medical Bills?

People all over the U.S. struggle to pay medical bills. The unpaid hospital bills will pile up quickly from an unexpected illness. Due to the lack of medical insurance, you may have received a minimum level of treatment and were discharged with a recommendation of going to see another doctor. How do they expect you to see another doctor when you can't afford to pay their medical bills?
This is the sad reality of the medical industry in the United States. While the current administration promises a resolution, what do you do in the mean time? There are options, however none are absolute. Americans neglect their own health issues until their body won't let them anymore and sometimes it is too late by then. Waiting makes the issues worse yet many cannot afford the preventative measures and checkups necessary. Your health should be a priority, but the expense of medical bills sometimes makes that impossible.
Medical assistance is available through state and federal programs for some people. Those that are offered medical insurance through their employer sometimes can't afford it or they have it and it is not as effective as it should be. The rates of insurance are high, the deductibles are high, the co pays are high and the percentage the insurance covers is low. For those who do have insurance these numbers still equal needing help to pay medical expenses.
Medical advocates can help with unpaid hospital bills; however their assistance is limited too. They can find errors in billing and negotiate the numbers, but in the end you still have to find a way to pay medical bills. When there is nothing left to rob from Peter to pay Paul, it is time to consider a different approach to resolve your medical expenses.
Many have not considered bankruptcy to alleviate the stress and financial burden of medical expenses, however many are forced into bankruptcy due to unpaid hospital bills. When you do not have the means to pay medical bills, consult with a bankruptcy professional to help you make the best financial decision.

Not Enough Financial Assistance With Medical Bills

Millions of Americans need financial assistance with medical bills. In times of decreasing budgets, many states cannot provide the needed assistance to low income adults or the elderly. States do provide full medical coverage for children. This leaves millions of Americans with unpaid hospital bills.

Many adults pay for their medical insurance through their employers. However, many can't afford to pay the high out of pocket deductibles or the bills not covered by the insurance company. Unfortunately, since the decline in the economy, the insurance rates, co-pays and deductibles continue to rise. The percentage that the insurance company pays toward bills has decreased, thus adding to the unpaid hospital bills debt.

The current administration claims to have a plan to ensure medical coverage for all. Not everyone agrees the plan is a permanent fix. If the medical coverage crisis plan is passed, it will take time to implement. This would mean a restructure of how medical claims are processed. In the mean time what about the billions of dollars in unpaid medical bills that Americans have accrued from lack of coverage?

Those who need financial assistance with medical bills often set up a payment plan with the medical provider. This is an ideal way to show good faith toward the creditor. But in general, the small monthly amount that goes to pay hospital bills is not enough to make a difference. At the minimum payment of $25 per month the balance on the unpaid hospital bills could outlast the patient. If your situation is similar to this, then it is time to consider alternate methods to resolving your unpaid hospital bills.

When the calls and letters become overwhelming and you know you have no means to pay hospital bills, filing bankruptcy may become your only option. Many people who cannot receive financial assistance with medical bills turn to bankruptcy to relieve the stress of the extreme debt.

Mistakes to Avoid When Filing for Bankruptcy

Bankruptcy is a very serious court proceeding, one that will affect your life for the next ten years. Understanding what takes place during a bankruptcy, and knowing what each Chapter of bankruptcy means for you and your creditors will help you avoid some of the most common mistakes that take place during these proceedings.

The Most Common Mistakes In A Bankruptcy Filing

• Failure to disclose all debts to the court

• Failure to disclose all forms of income to the court

• Attempting to hide assets

• Failing to attend required credit counseling class

• Missing appointments or deadlines set by the court

When you are seeking bankruptcy relief, either through a Chapter 7 total liquidation or a Chapter 13 debt restructure, you will need to claim all of your outstanding debts, even if they are currently in good standing. You cannot "pick and choose" which creditors you wish to continue paying and which you wish to file against. The court will not accept this type of bankruptcy and creditors will petition the court for relief if it is discovered that you have not claimed all of your debts on your bankruptcy request.

When you are filing bankruptcy you will be assigned a counselor by the court. This counselor will review your debts and your current income levels to determine which type of bankruptcy protection you can file for under their guidelines. If you fail to disclose all types of income that you have, not only will your request for bankruptcy be declined, you may also face criminal charges for fraud.

In an effort to protect assets, many people will "give" away valuables such as stock, property, art work or jewelry in an effort to keep their goods instead of being forced to sell them to pay creditors. It should be noted that the court will research your transactions for up to 5 years prior to your filing to see if any such "gifts" have been made in order to hide assets.

In 2005 changes to the Bankruptcy Code requires that anyone filing for protection must attend credit counseling. Many people believe they can say they attended this type of session when they have not. The court will verify that you attended counseling.

The court is very strict about compliance with appointment times and deadlines for paper work submissions. If you miss an appointment or do not have paperwork submitted in a timely manner you risk having your case dismissed. If your case is dismissed, you can be denied reapplication for bankruptcy protection for up to 6 months after the dismissal.

How to Select a Trustee for Bankruptcy

Choosing the right bankruptcy trustee is important to ensure that you are aware of all your options and that you get the best settlement at the end of the process. A bankruptcy trustee does not work either for you or for your creditors. Instead, they act as sort of a mediator or referee between the different parties involved in the bankruptcy case.
The bankruptcy trustee is responsible for selling your unprotected assets and distributing the money to repay your creditors. Additionally, the trustee can provide debt counselling services to you so that you may avoid bankruptcy altogether. For example, the trustee might arrange for a special arrangement in which your creditors forgive any missing payments so long as you promise to resume making regular future payments.
Another type of possible settlement might involve paying your missing payments in "installments" along with your regular payments over a set schedule.
What do I look for in a trustee?
As you may have noticed, a bankruptcy trustee is important because they can help you through a complicated legal process and they might even be able to help you avoid declaring a bankruptcy in the first place. For this reason, the trustee should be someone who engenders trusts and someone who makes you feel comfortable when discussing your financial and personal matters.
You should not select a trustee who is hesitant to answer all your questions or who gives you the feeling that they are impatient with you. In order to know all your options, you will need a trustee who is willing to take the time to do their job properly.
One of the best ways to get a feeling about your trustee is to meet with them in person first. This will help give you an idea of whether you can work with them on your financial matters. As with every counselling service, you need to feel 100% at ease when working with your selected trustee. The trustee should, additionally, be easy to contact when you need help.
The average person will want to select a firm that specializes in working with average clients rather than big firms or wealthy individuals. You do not want to be low on the trustee's priority list when it comes to service. In some cases, you may be able to get recommendations from people that you know and trust who have used trustees for their own bankruptcies.

Consolidating Unpaid Medical Bills

Unpaid medical bills can be a drag. Most of the time, people don't save up for a medical emergency. Part of the reason for this is the thought that bad things only happen to other people. That sense of invulnerability has driven many into bankruptcy because of unpaid medical bills. If you count yourself among these people, don't worry. There are options. Consolidating medical bills is a great place to start.
Consolidation can have its distinct disadvantages and advantages, just like any option. However, it's important that you weigh the pros and cons of consolidation with other alternatives before you proceed. Generally speaking, you should consider consolidating your unpaid bills if you have exhausted all possibilities for charitable funding, such as asking the hospital for discounts, applying for medical assistance programs from the state, or borrowing money from a rich relative at little or no interest.
There are two methods to consolidate your unpaid bills:
First is through a loan from a bank or financing institution. You must remember that this type of loan is secured so you may need to offer collateral-either your house, car or any other asset. One advantage of this route is that it carries a lesser interest rate compared to unsecured loan. Essentially, you're putting your credit history at stake here. Banks, especially now when times are dire, are not wont to offer consolidation to somebody with a credit score below of 600. Consolidation will restructure your unpaid medical bills so you can make lower monthly amortization payments. However, you will pay more in the long run because the process stretches your principal loan in addition to the interest rate that accrues over a longer payment term.
The second way is to seek the help of a debt management company which can bargain with the credit collection agency trying to recover the hospital's money or the hospital itself to reduce the unpaid medical bills to more manageable levels. One advantage of this method is you don't risk your credit history, although you will have to pay the debt management company for its troubles. The service provider should be able to provide you with details, but you should still insist that they report to the credit bureau that your unpaid medical bills are already paid as agreed or paid in full.
When dealing with unpaid bills, the important thing is to never panic. Talk it out with your family, doctor, friends, or even colleagues and solicit suggestions to find out the best option for your situation. Know that you are not in an island by yourself. Millions of Americans are in the same boat as you. While that thought may offer no consolation, it does means there are avenues to settle unpaid medical bills if you just put a little effort into tracking them down.
