How To Settle Unpaid Medical Bills
Unpaid medical bills are one of the top causes of bankruptcy filings in the United States. On the one hand, the desperation of the families involved is almost palpable that they decide that going to court is the only option for them to ward off the creditors while they still deal with the disease, or the ensuing aftershock, that befall them. There's no sense to judge them of dodging their responsibility to settle the unpaid medical bills.
On the other hand, this type of system that drains on private and public resources will not be sustainable.
How to settle the unpaid medical bills?
Don't ignore calls: Be it from the hospital or the collection agency. The hospital will send you the bill through the mail and without payment, the medical provider will send your bill to the collection agency. This is, in fact, another opportunity for you to bargain to reduce the medical expenses. Most collection agencies, despite their reputation, are actually agreeable to negotiate with the debtor. Even if you have no money, it's better to be upfront with them and find a common ground rather than ignore their repeated demands for payment.
Ask for help: If applying for a medical loan proves too much for you, how about asking for help from your friends? Research for assistance programs: The federal government has its medical assistance program but the lines could be very long. Local state programs also offer medical assistance so it's best if you can inquire from your local health agency on how to avail of these programs to settle unpaid medical bills. Your own hospital also has its own charitable program that will cover some, if not all, of the medical expenses incurred during your stay.
Non-profit organizations: Cancer, diabetes, Parkinson's and other lingering and degenerative illnesses like usually have their own support groups. You can inquire if they have some kind of financial assistance programs to help you settle your unpaid medical bills of if they may able to refer you to a friendly doctor who is willing to defer his professional fee.

Medical Bankruptcies - The Growing Reality
Catastrophic illnesses are claimed to have triggered approximately half of all personal bankruptcies in the United States. According to recent findings from a Harvard University study, most people who go bankrupt because of medical problems also have health insurance. Researchers found that many private insurance plans that offer limited catastrophic coverage were inadequate and offer little financial security for less severe illnesses.
Questionnaires were distributed to 1,771 bankruptcy filers in 2001 in California, Illinois, Pennsylvania, Tennessee and Texas. According the study, a total of 1.46 million personal bankruptcies were filed in the United States during 2001.
Nearly 1,000 individuals questioned gave detailed interviews about their financial and medical circumstances. Sickness and rising medical bills were cited as the cause, in part, for 46.2 percent of the personal bankruptcies. The numbers grew to 54.5 percent when an additional three other factors were included as triggers for medical-related bankruptcies: birth, death and gambling addiction. The study assessed that medical bankruptcies currently affect approximately 2 million Americans annually, including 700,000 children.
The study also cited that a majority of individuals looking for court protection from creditors had health insurance, with more than three-quarters reporting they had coverage at the beginning of the health catastrophe that triggered their bankruptcy. The study also found that 38 percent of the participants had temporarily lost coverage by the time bankruptcy was filed, with catastrophic sickness or injury frequently leading to both job and insurance loss.
Unfortunately, it’s become apparent that, for many Americans, serious illness often leads to job loss, which also means loss of health insurance. High-priced coverage through COBRA, while well intentioned, is meaningless if people can't afford to pay for it. Bankrupt families also lose more than just assets. One out of five families goes without food. A third had their utilities shut off, and nearly two-thirds skipped needed doctor or dentist visits.
The study’s findings also indicated medical-related bankruptcies often hit middle-class families hard; with 56 percent of the filers being college graduates who owned a home. The study did not, however, examine how many bankruptcy filers were from dual-income families, where both partners had medical insurance.
The Harvard findings echo previous studies which have generally reported that a majority of bankruptcy filers cite medical problems as a primary cause of bankruptcy, as well as other factors, including easy credit, job loss and financial mismanagement.
Many health insurance experts suggest that the Harvard study did not adequately explore the role disability income protection plans and personal savings can play in helping individuals with medical problems avoid bankruptcy.

Medical Bankruptcies Up
Perhaps you are unaware or maybe you have indeed heard the statistic that 50% of all personal bankruptcies are caused due to medical bills. Often, far too often the folks actually had medical insurance, but the co-pays, deductibles or items not covered exceeded the ability of the patient or the patient's family ability to pay. Most of these medical debtors were not lower class, rather middle class. The upper middle and upper class was able to weather the storm and onslaught of medical bills much easier. This tells us one thing, it tells us that the healthcare system is out of control and completely broken.
Throwing more taxpayer money at universal health care or mandatory health insurance, will only bankrupt employers and cause even more havoc with consumers. Insurance prices will rise, even if the risk is spread out over all citizens. Worse is the problem of what to do with illegal immigrants getting free health care and soaking up services, causing prices for paying customers, clients and patients and insurance rates to go up to cover those losses. Something must be done.
Even a simple emergency like a broken arm for a child could cost over $35,000.00 and many families simply cannot pay or they have to max-out their credit cards to do it. In Indiana for instance the problem is so bad that medical induced bankruptcies were up 25% in 2007 alone. And with the mortgage crisis, this adds fuel to the fire and some bankruptcy court personnel are calling it the perfect storm. Many consumer faced with medical bills are foregoing treatment, only to have a worsened crisis later, that will only cost themselves and the taxpayers more later, by then it might be too late. Think on this.

Health Insurance Bankruptcy - A Common Dilemma
Medical bills are the leading cause of bankruptcy, according to a Harvard University study, which also showed that more than 75% of those who declared bankruptcy because of mounting medical bills had health insurance at the start of their illness.
These days, the word "insurance" may be a misnomer. Health care coverage no longer insures that the bulk of your medical costs will be paid. The safety net that medical insurance provided in the past has become riddled with holes so large that many people are falling through, leaving them nearly as vulnerable as those without insurance. These people are considered underinsured.
Two reasons for the recent upsurge of people who are worrying about health care costs and struggling to pay their premiums, even if they are employed and have health benefits through work or are eligible Medicare are below.
First, health care costs are rising at twice the rate of inflation and most Americans can't keep up. Bigger chunks of a person's income now go toward paying for insurance and treatments. Prescription drugs can be costly also.
Second, employers are passing more of the financial responsibility for health care onto their employees. In an attempt to save money, employers are switching from comprehensive coverage( broad contract that provides coverage for almost all types of medical expenses, with a few internal limits, and usually subject to a small deductible and coinsurance), to high deductible coverage. The result is that employees bear more of the cost. Premiums for health insurance through employers increased nearly 8% in 2006.
With the cost of maintaining health skyrocketing, consumers are desperately seeking ways to keep out-of-pocket costs as low as possible. Unfortunately, some options look good at first glance, but could end up further emptying your pockets. One way you can ease your worries is to fund your own health care by putting money in reserve. There are two ways to do this. Flexible spending accounts and health savings accounts (HSA's)..
Flexible spending accounts allow you to set aside money from your paycheck before taxes are taken out and use the account to pay for medical expenses throughout the year. Because you lose whatever money is left in the account at the end of the year, flexible spending accounts work best for known recurring expenses, such as regular prescription costs.
A health savings account works somewhat like a long-term flexible spending account, enabling you to save for medical expenses on a tax-free basis, but you also must have a HSA qualified high deductible health plan. Anyone younger than 65 who buys this type of policy can open an HSA. You cannot be enrolled in Medicare, however, or covered by another insurance policy that isn't a qualified high deductible plan. Contributions to HSA's are limited and adjusted annually. Unlike with a flexible spending account, the money in an HSA is yours and can be rolled over and used in future years, and even grow through investment earnings.

A Complete Guide to Medical Bankruptcy
The health care system in the United States is broken. About half of all bankruptcies are declared because of insurmountable medical bills, and of that huge number, about 75% of them had health insurance when the problems began.
Medical bankruptcy is not a problem of the poor or the upper middle or upper class. It is a problem for the middle class and the lower middle class - people who work hard, do their best to pay their bills, and raise their families.
All it takes is one major illness or accident and even if they have health insurance, they can owe many thousands of dollars in medical bills. If the accident or illness causes them to lose their job, and thus their health care insurance, their medical bills can run into hundreds of thousands of dollars.
There are two main causes for the huge upsurge in medical bankruptcies:
The first reason is that health care costs are rising at an alarming rate - about twice the rate of inflation. Insurance premiums go up, and insurance coverage goes down. Prescription drug costs are out of control.
The second reason for the huge upsurge in medical bankruptcies is that employers are passing a larger and larger portion of the cost of health insurance along to their employees. Most major employers have switched the health insurance in employee benefit packages from comprehensive coverage that covers almost everything and has a small deductible to a limited coverage policy with a high deductible. The cost of the insurance passed along to employees has gone way up, while the benefits offered have gone way down.
The insurance companies are doing very well. The health of their bottom lines has never been better. The middle class and lower middle class families are in a financial crisis. Until something is done to curb the cost of health care and reign in the insurance companies, you can expect to see more and more medical bankruptcies.

How I Saved My Husband's Life and Our Bank Account
My husband had sudden cardiac arrest a few months ago and luckily I performed CPR on him that inevitably saved his life. Fortunately, I have written many books about saving money in healthcare and this was no different. Many people get "lost in the emotion" while the bills pile up. I put my rules to practice once again, and proved that you can save, even in an emergency situation of a loved one.
1. Make sure you have a Power of Attorney: This is the designation of someone to act as the sole decision maker in your absence. In my husband's case, he was unable to make any decisions while he was unconscious for three days and could not deal with the stress of bills during his recovery. By having a Power of Attorney, I was able to make medical decisions on behalf of my husband as well as get copies of our bills to review and question all mistakes in a timely matter...and there were plenty of mistakes! This is not automatic when you are married!!!! Be sure to keep a copy at your local hospitals, with your insurance company, as well as at your home and office. You may also opt to file an Advanced Directive which contains both a Power of Attorney for health care and a Living Will. You can get these form free online and have them notarized at you bank. Some health insurance companies have their own forms that you can simply sign and fax in.
2. Does the provider have the correct health insurance information: Have your card and a copy of your spouses card on you at all times. One slight mistake, even if it seems obvious, is cause for your insurance company to reject your claim. During our emergency, one of the providers switched my husband's first name with his middle name. This caused some major reimbursement problems for us until I discovered that on some of the medical records being submitted to the insurance company, my husband's middle name was being treated as his first. At another point, someone submitted his "membership number" incorrectly. By having a copy of the card I was able to point out the errors before the billing got out of control and provide the medical facilities with a copy for their records. It may seem obvious, but mistakes happen, especially in a rushed situation.
3. Ask for an itemized bill BEFORE you leave the hospital: You may not get it immediately, but you should get this before you get your bill summary when you will be on a deadline to pay. At that time you, can double check for mistakes on your bill. I found many mistakes including double charges that are not necessarily obvious on the billing summary.
4. Keep you own records: It is extremely difficult to keep track of anything when you are an emotional wreck, but this is where an itemized bill may jog your memory on procedures that were done, medications that were administered or were not. The first night we were in the hospital, a friend of mine brought me a journal to jot down my feelings as a form of "therapy" when I was alone during those hours of silence and could not sleep. I actually used this journal to write down questions I had for the nurses and cardiologists on my husband's condition as well as keep track of dates and people that came to visit my husband. This came in very useful when we received our bill a few weeks later only to find we were charged for items and procedures never performed as well as a whole day before we actually checked into the hospital. (The bill stated procedures were performed on the 9th when he did not have the arrest until the 10th)
5. Make friends with the right people: Many hospitals have patient advocates which are people you can turn to for most of your billing questions. Since most hospitals outsource lab work as well as different physician groups, it is very helpful to get to know this person. In our case, we were dealing with many billing agencies which became overwhelming. One of the patient advocates not only helped me locate the correct contacts at the billing departments, but assisted me in getting the correct insurance information to those billing departments that were submitting it incorrectly. In my husband's case, he was brought to the Emergency Room of one hospital and transferred to one with a "more equip" cardiac care unit. The patient advocate from one hospital supplied me with the contact information for his equivalent at the other hospital.
6. Ask questions and ask for the supervisor: Three hours in the emergency room cost us over $11,000, and it looked as though the claim was submitted. When I called the billing department initially, I was told that my insurance did not cover that particular emergency room. Thinking I was going crazy, I double checked with my health insurance and they informed me that that particular emergency room may not have been covered, which was possible, but I chose my health insurance of the emergency rooms in my area being covered. At that point, I politely asked for the supervisor and she gave me the correct codes that the hospital should have submitted as well as explained that the hospital may have been delayed in their submission. Still unsatisfied, I called the manager of the billing department only to find the codes were incorrectly filed and they would resubmit the bill immediately. Again, I documented everything and have not had a problem since. Always ask for the person in charge if you are not satisfied with the answer. I found out the person I was dealing with at first was new to the job, thus I was given misinformation.
7. Ask for financial assistance: Even if your insurance covers most of your bill, a high deductible can be detrimental to your bank account. Don't be afraid to ask for financial assistance. Write a letter immediately describing your financial need and ask your patient advocate who to submit it to. Some hospitals offer discount for paying bills in a timely matter, others may write it off. My husband has done so much volunteer work at one hospital that they wrote off their bill, the other offered a 20% discount for his volunteer work over the past 13 years and an additional 10% discount for paying the balance in full within 30 days!
8. Ask for everything in writing: Avoid any miscommunication by getting everything in writing. The hospital that wrote off the balance of my husband's bill sent a balance a few weeks later. Luckily, I had the name of the person I spoke with, her contact information and a 0 balance on the itemized bill she sent me previously. When I contacted her about the bill, she said it was an accident and she would forward the 0 balance document she had sent me previously to the billing department and a copy to me.

Can Medical Bankruptcy Shield Your Assets? What to Do If You Need Help Now
Medical bankruptcy is one of the most misunderstood terms in medical finance. There is actually no "medical bankruptcy". That being said, medical problems have consistently been one the 3 leading causes of bankruptcy in the United States.
Although there is technically no medical bankruptcy a medical problem can certainly cause you to find yourself in bankruptcy court. Medical problems can be a double whammy; they reduce or eliminate your income and cause you to incur massive debt. In many cases you have virtually no chance of ever repaying this debt, it's just too large. Many people find themselves in a position of losing their homes and other valuable possessions in an attempt to repay their huge medical bills.
Often, seeking the protection of bankruptcy isn't something desirable but it's seen as the only way out. You may think that having health insurance will provide protection against such a financial calamity, however almost 50% of all bankruptcies are caused by people facing massive amounts of medical debt even though they had medical insurance at the time of their accident or illness.
Sadly, there are also a significant percentage of medical related bankruptcies that are filed by people that aren't really facing huge medical bills. Almost 40% of medically related bankruptcies were filed by people who owed $5,000 or less in medical bills. In many cases this is due to the medical industry being much more aggressive in collection actions than they once were. In other cases people are just not educated about how to proceed in such cases. Once the collection letters begin arriving, fear sets in, and many people just don't look at all their options.
Yes, filing a chapter 7 bankruptcy can protect your assets and allow you to keep your primary residence if your home falls within state guidelines. These vary by state. Filing for bankruptcy protection however, is can present you with huge problems down the road and will essentially destroy your credit rating. You should carefully consider your other options before considering using bankruptcy as a shield to protect you from medical bills.
You might consider calling an attorney in your state that specializes in such matters. Your first call however should be to your creditors. The first line of defense should be making arrangements for some sort of alternate payment plan. Bankruptcy is a messy business and most creditors would rather avoid is almost as much as you would.

Medical Bankruptcies Are Increasing at an Alarming Rate in America
They say that the average US Citizen only has enough money in savings for an average of 4-5 weeks with no income. If the money stops coming in they are financially bankrupt. That includes the balances on their credit cards and any home equity lines of credit, which these days are almost non-existent. Just imagine losing your job at a time like this, and many Americans are due to hard economic times and large corporations trimming jobs and announcing huge lay-offs.
Now suppose you get sick or a family member has a huge problem, one which either your insurance will not cover or you never had medical insurance in the first place. You will not be able to pay the medical bills and you will be forced into bankruptcy. The health care system in America is broken and the prices have become so high that it's hardly viable. In fact, more and more people are filing bankruptcy due to medical bills that they cannot pay.
Did you know the medical bankruptcies are the most common of all reasons for folks filing bankruptcies? It's true and they are up by a huge margin, especially in places with lots of senior citizens like Arizona and Florida. The American consumer is already tapped out due to credit card debt, high food prices, increased drug costs, outrageous gasoline prices and when one little medical emergency comes along, it puts them in the poor house.
Medical bankruptcies are out of control and in some areas they are up by 300% over the last three-years alone. And you thought that the mortgage crisis was a big deal, sure it is, but after you have a medical emergency in your family, I bet your thoughts change on this issue. Please be thinking here and be smart about your health care costs and insurance.

Fast Medical Bankruptcy Alternative - Medical Grants
When medical bankruptcy seems like the only remaining options for all of your medical bills, make sure you didn't overlook the medical grants that may be available to you. When a serious medical condition arises, even those with proper insurance can find themselves in hundreds of thousands of dollars in debt. This can not only deplete a life savings and destroy your credit score, but it will create a level of unnecessary stress that can tear at a family.
Every year millions of people are faced with filing for medical bankruptcy, and billions of dollars is left unpaid to hospitals and medical practitioners. This destroys the individuals finances, hurts the medical community, and can damage the economy as a whole.
This is a serious problem in the medical community and with American citizens at large, which is why the government and private foundations provide medical grants to help people with their medical bills. Every year the government sets aside billions of dollars to help people out with financial aid, and there may be medical grants available today for those who need help paying their bills.
Often non-profit organizations will host fund raising events to help those individuals suffering these financial storms and will provide funding to help people escape these debt problems as a result of excessive medical bills.
When medical grants are obtained, they never have to be paid back and they may be available to those who have no other option but to file for bankruptcy. No party involved wants the individual to file for bankruptcy, which is why medical grants can be a great win-win situation and help avoid filing for medical bankruptcy.

Filing Bankruptcy Due to Medical Illness is Not the Solution to Your Sleepless Nights
The medical bills are piling up in the mail box. You can't afford to pay them even with health insurance. Let alone without any insurance at all. So now you are considering bankruptcy as the only way out. Filing bankruptcy in the long run wont really solve the problem. What if you get sick again, and the bills start piling up again? You can always file again in 7 years but you may end up with two bankruptcies on your credit report. What is the solution to this stressful problem?
You can get someone else to pay for them. Especially if you are unemployed, and have large amounts of medical debt. Apply for the medicaid program through your state government. Whether you are a man or a woman you may qualify for aid. Although women, & pregnant women usually have a somewhat higher approval rate. You may even qualify if you have a mental disability like depression. Submit all of your bills along with the application.
You can take the route of credit repair and dispute the bills. Get a copy of an itemized bill most likely you have been over charged. I was in the hospital once overnight, and was billed $80.00 for 1 pill that was generic. I could buy a 90 day supply of that same drug at Wal-Mart for $10.00. Which brings up a good point. If you do get admitted to the hospital bring your own medication. The hospital will jack up the price of whatever medication you are prescribed. I wrote an ebook that goes into great detail about repairing your credit from medical debt. Visit my site for more details.
If you are worried about finding a job with a bankruptcy on your credit report, your fears are limited some. Usually the banking, finance, & gaming industries pay close attention to checking your credit report. Bad credit gives them the idea that you are a higher risk because you might steal from the company. Many years ago I applied for a job with a credit union. They wouldn't hire me because at the time I had a lot of unpaid medical bills in collections reporting on my credit report. And I had no intentions on stealing any money to pay them. In fact I forgot they were there in the first place.

Tough Times and Health Problems a Recipe For Bankruptcy
A recent study shows that 62.1% of personal bankruptcy cases in 2007 were linked to medical expenses. Given our countries financial crisis it's safe to say that this is an even bigger problem today in 2009. In this study released by Harvard professor Elizabeth Warren it showed that most medical debtors were middle class families that owned homes, were employed, and 75% had health insurance.
So what does this study reveal about our current health care situation? One serious illness can cause unaffordable medical expenses or a decrease in or lack of income which results in bankruptcy. Most families have nothing to fall back on if they become ill and lose their job, which consequently causes the loss of health insurance.
Most all bankruptcy debtors had some medical debt, but about half of the debtors, according to the study had mostly medical debt. While this study only encompasses a handful of bankruptcies, 2,314 to be exact, it does make sense. In 2005 laws were passed to make bankruptcy a bit harder to obtain, yet the numbers increased after a few years.
So what are bankruptcy lawyers saying about this study, a few are totally disagreeing with the study saying it is propaganda to back up a government run national health care plan, but most agree that almost all bankruptcies have some medical debt attached.
Health care in the United States is like a game, you can get a plan that seems to cover the needs you have and everything is fine, but given a change in those needs and your finances can be devastated. It is good to know that bankruptcy is an option, but this is really a problem that must be addressed. It seems like a crap shoot when choosing a health care plan and most don't get to choose, they get what their employer offers. Every plan has different co-payments, different prescription plans and different deductibles it is impossible to feel confident that you will not fall into this terrible predicament.
People think they are doing everything right, they go to college, get a good job, buy a house, have a family, and get what they think is good insurance but then it falls short, very short. So what do they do? They use their credit cards to pay bills, take a second mortgage on their house to pay outstanding medical bills and then find themselves in a unable to make all the payments, so they have to file for bankruptcy. Because they have paid the medical bills they are not outstanding in many cases but they were the cause of the credit card bills and other bills that are outstanding.
Clearly bankruptcy isn't limited to undereducated people who can't get or keep a job. It touches the middle class much more than most people think. Until something is done about our health care situation, people will continue to use bankruptcy to help with their financial problems caused by an illness. At least that is something.

Consider These Medical Debt Bankruptcy Facts
When folks ponder bankruptcy, they as a rule imagine cars, houses, or credit cards. They more often than not will not consider medical bills. But the reality is that a big part of the bankruptcies filed in the United States are thanks to overwhelming medical expenses that people cannot pay.
If you are somebody who is considering medical bankruptcy, here are a few things that will give details to you the two kinds of bankruptcy and the ways they surely will affect your costs and the different ways they are going to affect you in the the near future.
Chapter 7
This sort of bankruptcy will wholly exonerate most of the debts that somebody has, which will likely include all of the person's medical costs. The unpleasant thing about this type of bankruptcy is that it will remain on a person's credit report for a decade, which is a exceptionally long time. This will also really affect their credit, even if that person filed it only because of their medical costs.
Chapter 13
This kind of bankruptcy involves the reimbursement of debts, supervised by a court of law, and it protects the defaulter from being taken to court by the individuals the person is owes cash to. It also promises protect their belongings. All of a patient's medical bills will be able to be paid back in this style, and every so often the bills are settled for under the original amount. Unlike Chapter 7, this bankruptcy only lasts on someone's credit report for seven years.
If you have loads of medical expenses, it's chief to look at all of your options and use them up before you file for bankruptcy. No matter how bad it has become, there is going to be a way for you to get assistance. Bankruptcy ought to be your last option, because it is something that will bring down your credit and will be with you for many years later.
Previous to jumping into bankruptcy, speak to your doctors and the clinics that you owe money and investigate if there is anything at all that they can do for you. It can be awkward, but it's a better option to filing for bankruptcy, and odds are that it probably will have a superior conclusion for you.
Examine your costs, study your options and scrutinize yourself before you choose. Let this be your very last choice when there's no other option.

Taking Care of Past Due Medical Bills
Thanks to the decline of the economy, a lot of people are finding that they have a stack of past due medical bills. The stack gets larger and larger every month, and they don't know how they are going to manage to pay them.
Here are some steps that you can take to deal with unpaid medical bills.
Look at Your Budget
The first thing that you want to do is take a look at your budget. If you don't have one yet, make one up. List all your expenses and your income for each month to figure out where your money is going.
Get the Bottom Line
Go through your past due medical bills and make a list of what you owe. If you don't have your latest copy, call the number that is on one of your older bills and find out what your current total is.
Negotiate
Talk to the offices and hospitals that you owe money, and see if they would be willing to come down on the amount that you owe. If you have the cash available, let them know that you will pay them right now if they are willing to lower the amount that you owe.
Ask About Payment Plan
If negotiating isn't possible, ask them if you can make payments each month. If they suggest a figure, make sure that it's something that you will be able to do. Chances are that you will be able to come up with an agreement that will work for the two of you. All you have to do is make sure that you are polite and that you remain calm throughout the talk. This is going to increase your chances of the billing staff listening to you.
The times are tough for everyone, but that doesn't mean that people will be unreasonable. If you come up with a plan and you show that you have done your homework, you are going to show that you are serious about waning to take care of your past due medical bills and squaring everything away. Be educated, be prepared, and be polite. These three things are what will help you to plead your case to your debtors and get your bills taken care of before they ruin your credit.

Medical Bankruptcies Continue to Surge Amidst the ObamaCare Proposal
While it is true that most of the foreclosures happening in the United States were caused by substandard mortgages, and/or the fact that many people have lost their jobs and can no longer make payments, there is also another reason for the foreclosure rate. Many people have filed for bankruptcy due to medical bills piling up.
This happens when the insurance company does not pay for the cost of care which has been rendered, and the patient simply can't pay the bill and has no choice but to file for bankruptcy, and in doing so they often end up losing their home along with all their other financial problems.
Even though ObamaCare health care insurance proposal is making its way through Congress, for some people it will already be too late. The number one cause of bankruptcies in the United States is from medical bills that the patient can't pay.
Recently, due to the recession, job losses with the breadwinner in the family have become the number one cause of bankruptcy. It is obvious that our health care system is broken, and that is something that both Republicans and Democrats agree with. It is also something that lawyers, doctors, and even hospitals and HMOs agree with as well.
Even pharmaceutical companies agree that our healthcare system is broken. Apparently, we are trying to get it fixed, but until we see changes in these excessive medical bills, it will continue to be the number one or number two cause of bankruptcies in the United States of America. I hope you will please consider this because it is a serious issue and deserves national attention and perhaps a debate amongst the American people.

What You Need to Know About Unpaid Medical Debt
Medical debt happens to be a dominant bankruptcy cause across the globe and primarily in the United States. Most often when people are not able to get rid of their unpaid medical bills they make the serious mistake of declaring insolvency. So let's go over a few important points on how to avoid hospital debt.
Another typical mistake that most people make in regards to their hospital debt is to transfer it on their credit cards. Transferring medical debt on your credit card isn't even a solution, forget about being a good one. You would be aware that the interest rate of credit cards is in general higher as compared to your medical agency. Plus, shifting the bill to your credit card worsens your possibilities of a Medicaid refund.
If you have serious unpaid s on your head, you need to be all the more prompt to clear as much payment as you can and as quickly as you can. Being proactive in paying your debt is always advisable.
It's also useful to negotiate with service hospital about clearing your unpaid medical debt. When you have not cleared any of your medical bills the service hospital would be rather easy in looking to settle payment arrangements with you so as to get whatever little that they can get. Note that the doctor's offices are well aware of the fact that once you file for insolvency, they don't get their dues from you.
You should also try to contact some charitable organizations that look to help people who are battling with huge medical bills and out of all choices for repayment.
Instead of filing for bankruptcy cover, go to your state's health office and check about applying for Medicaid. If you get approved for it, your unpaid medical debt would be cleared by Medicaid plan partially or maybe completely.

It will have a awful result on your credit report and dampen your possibilities of receiving a loan or a job in future. Credit card payment is nothing more than a standby arrangement because the bill is only shifted from one source to another. Earlier you owed the health care provider, now you owe the credit card company.

First step in negotiating medical bills is to go through a detailed statement of your bill to see that you only pay for services that were provided to you. Go and check with Medicaid to see that the medical provider has not charged you extra for any service. Also ensure that you know what expenses of the bill will be paid by your insurance provider.
Secondly, you need to negotiate medical bills in an approach that is delicate yet firm. Always note that screaming and misbehaving with service representatives will not make things any beneficial for you. Instead, you ought to concentrate on trying to drive home the point that the bill is simply too high for your paying ability.
Be upfront in negotiation process. Carry a record of all your previous conversations in regards to the concerned matter and the name of the officers you spoke with. It's always a bad idea to negotiate medical bills over the phone.
Lastly, be accurate in what you strive for. You have to be very clear in your mind as to what you want from the hospital.

Medical Bankruptcy
When Americans think of a person trapped in enormous amounts of debt, inevitably they think of irresponsibility. They think of fast cars and fancy stereo equipment. They think of people living the high life who could not afford it. In short, they think of a deadbeat. If statistics are any real measure, this impression could merit a change - and a touch of sympathy.
Far from financial irresponsibility, medical expenses are among the most frequent causes of families falling into debt and eventually filing for bankruptcy. The precise percentage of medical bankruptcies is in dispute. However, it is generally acknowledged to be a significant number.
Estimates for the number of "medical bankruptcies" have a wide range. A Northwestern University researcher has placed the figure at 17 percent of all bankruptcies. A group of Harvard researchers have recently increased their estimate to more than 50 percent. According to a Federal Reserve report, households with high medical debt are 28 times as likely to file for bankruptcy as other households. Most recently, an August report from the UCLA Center for Health Policy Research estimated that one in seven Californians carries some form of medical debt. With the nation gripped in a discussion about public financing of medical care, the number of medical bankruptcies has become a topic of note.
Medical bankruptcy can arise in several ways. The most common and obvious is the medical bill charged to the ill patient. When the patient personally suffers a chronic disease, deals with a condition that requires expensive treatment, or must pay for pricey medication, then it can be easy to run up thousands of dollars in costs. Insurance can help, but sometimes is not enough. However, there are other ways that medical expenses can drive a person or family into debt.
Many times the medical benefit is not for medical procedures performed on the person himself. They stem from helping to finance the medical care of a loved one. Sometimes this means caring for an elderly father or mother. Sometimes, tragically, this means caring for a sick child.
Also, some researchers describe "hidden costs" of medical bankruptcy. Often, these expenses consist of medical expenses placed on credit cards or paid on credit in some other way. This is an unwise thing to do. Once the expenses are placed onto the credit card, they become a target for interest and fees.
While medical expenses drive many people to bankruptcy, that is not the only option for handling overwhelming medical debt. Other options exist that can help a debtor take care of their debt before reaching that point. Among these methods are credit counseling, debt consolidation, and debt settlement. Each method can help debtors resolve debt and rebuild their financial health.

Medical Bills and the Reality of Bankruptcy
The prospect of filing for bankruptcy protection is never appealing. But that does not mean that it is never the right choice. Much of the negative view of personal bankruptcy is wrapped up in social mores and pretenses, spurred along by a healthy dose of misinformation and misunderstanding about the law and the legal and financial implications of filing for bankruptcy. Though it would, of course, be preferable to you and your creditors if you were able to satisfy the terms of your repayment agreement, the economic pressures of life can prevent that, even if you have the best of intentions.
Certainly, an individual has a degree of financial responsibility and culpability in the matter. Willfully and knowingly making purchases with the intent to defraud creditors is inexcusable and may be punishable by criminal and civil actions. Additionally, it is advisable to maintain an open dialogue with your creditors so that you can attempt to keep them informed about your ability or inability to make specific payments. When this becomes impossible, however, bankruptcy may offer the most beneficial path to resolution as it grants your creditors partial satisfaction of a debt and it frees you from lingering financial obligations. Medical bills are by far the most common debt to trigger a personal bankruptcy filing.
Costs and Consequences
The news media and political agents in the United States devote significant attention and discussion to the high cost of healthcare in this country, and as anyone who has had to shoulder medical bills without health insurance can attest there is plenty to talk about. The complex scheme that presently exists, under which insurance companies and medical professionals both have an incentive to overcharge patients and to perform unnecessary tests and procedures has turned even the simplest visits into thousand dollar nightmares.
If you find yourself in need of more substantial medical treatment or care, then it is not out of the question for your medical debt to surpass your student loan or mortgage debt in terms of total value. There is no way that the average person can afford to pay for such expensive care out of pocket, but there is little in the way of forgiveness emanating from most healthcare service providers. A sample of the average 2005 cost of several common procedures can illustrate this quite clearly:
Tonsillectomy -- $12,355
Cardiac Stress Tests -- $15,691
Circumcision -- $5,057
Fracture or Dislocation of Hip or Femur -- $35,545
Amputation of Lower Extremity -- $52,306

The reason why you must realize this is because you are not alone and because of that there are always going to be people out there willing to assist you get your life back to where it once was.
To be able to help you get your life back to normalcy I have fitted 4 great methods to quickly avoid a medical bankruptcy. What you need to know about every one of these is there are great deals of other options as well but these are the shortest and most effective easy methods to stop a medical bankruptcy from happening. Just note that if you are not comfortable managing this on your own then be sure you get some good help or at least talk with somebody about what you are going through.
Tips On How to quickly avoid a medical bankruptcy.
Settle on the amount - Something that people do all the time is settling on an amount which they can pay back in a reasonable amount of time. Just like if you have a $ 20,000 doctor's bill that is past due then you definitely could perhaps get that discounted to around $ 14,000 and have all that setup on monthly bills. The reason why you really need to settle on the amount of money is because it won't show on your credit report if you do settle. What the majority of us think is that their medical bills will come about on their credit report but truthfully they only do if they are sent to collection. That is the main reason you need to do all you can to stop anything from maneuvering to collection.
Ask for discounted payments - If you are filing for a medical bankruptcy simply because things are too tight and you can't afford to pay for all your expenses and your day by day living then it is a chance to ask for a reduced payment coming from the medical facility. What the majority of us don't realize is the medical facility doesn't want to see you go through a medical bankruptcy and the explanation is really because they don't get anything out of the deal. This is why you need to call in and let them know what is happening and that you genuinely wish to have your monthly payment reduced each month.
Transfer amount to a credit card - This is normally not something I suggest doing but it is better than filing for a medical bankruptcy. What you must understand is if you transfer the amount you were supposed to pay to a credit card then you wont have any medical bills and with that your credit card companies wont have as much of a hold on your life like a medical facility would.
Just be aware that to counteract a medical bankruptcy you need to think outside the box and really know very well what you can do to live your life the way it ought to be.

Medical bankruptcy is a general term used to refer to the reason why a people need to file a bankruptcy. Actually, this is not a legal term. According to the its rules, if you are to file a medical bankruptcy, you need to either file Chapter 7 Bankruptcy or Chapter 13 Bankruptcy. In this filing, you need to comprise all your debts including all your medical debts and other unsecured loans. After some examination and it is proven that you are insolvent, they will free you from all your debts and will be declared into bankruptcy. When you file for a certain bankruptcy, you are required to list down all of your creditors, including your medical bills. This only clear up that 'medical bankruptcy' is not all about your medical debts.
Based on the statistics, provided by an article in CNN, medical debts is one of the basic reasons why people file bankruptcy. As a matter of fact, about 60% of the filed bankruptcy is due to medical issues. And almost all of these 60% are the single mothers and elderly.
Having health care insurance is not insurance at all. According to some medical bankruptcy statistics, almost 80% of the bankruptcy filers have insurance. This may be due to the fact that, even people have health insurance, they still bear most of the payments for the bills which forces them to file for bankruptcy.
Some of the people think that when you file a bankruptcy, doctors can refuse to cure you. Well, according to the federal law, those hospitals receiving subsidy from the government do not have the right to refuse from accepting a patient who had filed a bankruptcy. More often than not, the doctor and the patient are making agreement on the amount that the patient can afford to pay the doctor even he had suffered from bankruptcy.

What to Do When Medical Bills Overwhelm You
Medical bankruptcy may become the only option for a person, regardless of their current financial situation or what type of medical insurance they carry. The uninsured are at the greatest risk of falling into the deep pit of overwhelming medical debt. However, in this economy, with fewer employers offering comprehensive and major medical plans, the well insured are also vulnerable. This is because of something on their policies known as the deductible.
Everyone is vulnerable to catastrophe. When a person is admitted to the hospital for a critical illness or serious injury, initial treatment can cost in the hundreds of thousands of dollars, as in the case of a heart attack or multiple injuries. Long term treatments add to the cost and therapy even more. Medical bills totaling over one million dollars are not uncommon. Insurance will pay only the amount, less the deductible and the co-pay. So, for example, a $100,000.00 medical bill, assuming it is all initial treatment and care, is subject to 20 percent co-pay and a 10 percent deductible. That is approximately $30,000.00. Add to that therapy, corrective surgery, anesthesia and many other procedures and treatments all subject to the same deductions and you have a mountain of debt.
Bankruptcy, in the form of Chapter 7 or Chapter 13, is often an answer. Chapter 13 permits a person to keep any assets while paying off the debts in a three to five-year period. This may not be possible for debts of 50K or more unless the person can return to a high paying job. Chapter 7 removes the payment responsibility of the debtor and uses the sale of personal assets to pay off all or part of the debts. Chapter 7 is a good option in many cases. The filer keeps his home and car, furniture and clothes and can start over. A good bankruptcy attorney should be retained to navigate through the process and to protect you from creditors who refuse to play by the rules and continue to harass.
Will medical bankruptcy hurt your credit so badly that you will never be able to borrow money? Bankruptcy, although it is a mark on your credit that can last for ten years, is not the end of the world. Taking out a secured credit card with a bank or keeping one card current and out of the bankruptcy is a good way to start rebuilding your credit.

All About Medical Bankruptcy
Food, shelter and clothing, these are the basic needs of humans to live. But with the kind of world that we have today, I think money must be part of the list that I have mentioned because almost everything as of the moment, has a price tag attached to it. It is undeniable that there are a lot of individuals today are filing a medical bankruptcy. What do this term means? Allow me to give you a full grasp as regards this matter because it is a right that is given each and every citizen of the state.

In this kind of bankruptcy, you need to enumerate all the debts that you have both medical-related debts and non-medical debts. Also, you have to list all the creditors that you have.
Who are the people that most of the time experience financial problems? Based on the bankruptcy statistics, the single mothers and the elderly are the ones who usually file for bankruptcy. We all know that as individuals get older, the more often they got sick. On the other hand, single mothers shoulder all the medical bills of their children. Both these situations give the elderly and the single moms' mountainous medical bills which force them to file for bankruptcy.
One of the basic questions of the people who file for bankruptcy is that, 'do doctors have the right to refuse on curing them?' Well actually, that is really a good question. Based on the facts that I have collected, I have found out that doctors, especially those who are working for public hospitals, do not have the right to refuse to any patient. This statement is based on the federal law provided by the state, since the hospitals are getting subsidy from the government, they do not have the right to refuse to anyone.
Another good question asked by the citizens, 'how can I file a bankruptcy?' the answer is very simple. You just have to prepare all the requirements and file for it. But it must be noted that once you have filed for the bankruptcy, you cannot file for it for six consecutive years. This only connotes that you do not have any protection from unwanted and unexpected debts for the said periods.
If you are planning to file for bankruptcy, it is advised that you first consult a lawyer. If you do not have the money to pay for them, you can go to the city lawyers. Learning the basic facts and laws regarding the bankruptcy is a must if you wanted to file for it. Being knowledgeable and prepared is the key for a successful filing.

Medical Debt and Settlement - Hospitals Too Save Money With Debt Settlement
Critics of medical debt settlement point out that the whole concept of settlement of debt is not based on logic and common sense. To expect any individual or financial institution to offer a waiver ranging from fifty to seventy percent of the original amount owed does not make sense. No person will give such a huge waiver and cause such a huge loss.
This would have been true in the past before the recession hit the economy. However, this argument that does not hold any water today because America has been hit by one of its worst recession in the past seventy years. There are many who call this the worst recession after the Great Depression and there are some who are of the opinion that this is even worse than the Great Depression as well.
The primary reason why such a large number of persons are worried about this recession is the huge number of bankruptcies that took place. The number of bankruptcies can easily be used as the barometer to determine the condition of people in the country. If a large number of persons are declaring bankruptcy, then something is wrong in the way finances are managed in the houses of the country. On the other hand, if majority of individuals are in a position to manage their finances without having recourse something as drastic as bankruptcy, one can be confident that things are going on smoothly.
The recent recession saw a spate of bankruptcies that had not been witnessed in the past few recessions. Further, this recession has been, by far, the longest in recent memory. Considering all this, lenders are well and truly scared of the chances of recovery of their debt. What is going to stop the borrower from simply filing for bankruptcy? It is very pertinent to note that number of bankruptcies as increased despite the two thousand five amendments has made it difficult for the average individual to opt for bankruptcy.
Lenders have realized that it makes more sense to help the borrower out when he or she is facing a legitimate problem. It is possible to behave as if the problem of the borrower is the problem of the borrower alone. However, lenders have realized that their existence too is intertwined with the regular repayment made by the borrower. In case of medical institutions, all these arguments are applicable. That is the reason why the service providers are prepared to offer generous waivers as long as it helps them recover the funds properly.

Medical Debt Discount Tips - Is Bankruptcy a Better Option? Certainly Not
Negotiating a discount or a waiver with financial institutions seems like a fair thing to do. The service providers charge such high interest and other penalties and make life miserable for ordinary borrowers. Hence, ordinary borrowers never mind seeking additional discounts and bring down the profit earned by the lender. However, doing the same in case of medical institutions is not similar.
Many borrowers are hesitant to adopt such tactics with the medical service providers. There is a sense of gratitude as the hospital is the reason why the individual or any family members is still alive. Further, there is a realization that expenses incurred by the hospital have been incurred to save one's life.
The urge to make the payment on time in a prompt manner is very high. So much so that people contemplate bankruptcy and file for chapter 7 to escape all other debts because they used all their resources and their finances to pay for their hospital bills.
Always keep in mind that bankruptcy is going to hurt the medical institution as badly as it is going to hurt others. You may have repaid your medical dues in full but that does not mean the economy does not get affected when you file for bankruptcy. Further, it is incorrect to say that medical institutions work on not for profit basis. There are many service providers who charge a lot to just because they are in a position to do so.
This is no different than the exploitation of credit card issuers they charge extremely high interest rates from their customers. If you want to overcome this problem, you should be prepared to negotiate tough with your hospitals. If you are not confident of doing so, why don't you employee an impartial third party expert who can politely but firmly explain to the medical institution that you are not in a position to pay the bills charged.
This will help you overcome a very big problem that otherwise would have pushed you towards bankruptcy. A bankruptcy when a family member is very ill is even more harmful as compared to a bankruptcy in ordinary circumstances. Hence, just log on to the World Wide Web and get in touch with reputed service providers online. You can submit your details and the settlement companies will get in touch with you and negotiate with you to determine your expectations and your requirements.
